Kucker Marino Winiarsky & Bittens LLP Saves Property Owner Approximately $200,000 in a Favorable Settlement of ECB and DOB Violations
Shogik Oganisyan, an associate at Kucker Marino Winiarsky & Bittens LLP, saved a client hundreds of thousands of dollars and successfully obtained a settlement of defaulted and/or docketed violations issued by various New York City agencies. The client had been issued over 50 violations by New York City’s Department of Buildings (DOB), Department of Environmental Protections (DEP), Department of Sanitation (DOS), FDNY and various other agencies, which were outstanding and due in the amount of more than $260,000. These violations heavily encumbered the client’s property and additionally hampered any effort to sell the building at market value.
Shogik Oganisyan successfully made motions to set aside default judgments, secured new hearings, filed and obtained certificate of corrections from the DOB, and aggressively negotiated with the City of New York and Department of Finance in settling the outstanding violations. In the end, all of the violations were settled for a little over $60,000, saving the client approximately $200,000. The client was extremely pleased with the monetary savings and may now also seek the full market value of the property in a sale.
