KMWB Represents Upper East Side Landlord in Successful Owner-Use Proceeding
Andrew Bittens secured an order granting legal possession to a landlord against the last remaining tenant in one of two 19th century brownstones. The owner purchased both brownstones with the idea of combining them into a single family home for his family. Because the tenant was rent-stabilized, the owner was required to prove his good-faith intention to use the combined buildings as his primary residence prior to evicting the tenant. Following a trial, the Court held that the landlord met the burden required by the Rent Stabilization Law and ordered the tenant’s eviction.
