Rafael Dayan is a Senior Associate at Kucker Marino Winiarsky & Bittens LLP , where he represents landlords, property owners, and managing agents in the legal and operational issues arising from the ownership and management of New York City real estate assets.

His practice centers on helping clients operate, protect, and reposition buildings within New York’s complex regulatory and litigation landscape. Rafael regularly advises and litigates matters involving the New York State Division of Housing and Community Renewal (DHCR), the New York City Department of Housing Preservation and Development (HPD), the Department of Buildings (DOB), the Department of Finance (DOF), the Loft Board, the Tax Commission, and related administrative agencies governing real estate operations in New York City and New York State.

Rafael handles litigation in Supreme Court, Civil Court, and Housing Court involving commercial and residential landlord-tenant disputes, commercial lease enforcement, rent collection, holdover and nonpayment proceedings, regulatory disputes, ownership and partnership disputes, post-judgment enforcement, business disputes affecting real estate operations, and proceedings seeking vacant possession of buildings and units. He also prosecutes Article 78 proceedings and administrative appeals challenging adverse agency determinations affecting property owners and real estate assets.

Drawing on both litigation and business experience, Rafael approaches matters with a practical focus on achieving the client’s operational and financial objectives. While prepared to litigate matters to the fullest extent necessary, he views litigation as a strategic tool rather than an end in itself. He works closely with clients to develop tactical, business-oriented solutions designed to resolve disputes efficiently, preserve leverage, and protect long-term asset value.
