Gov. Cuomo’s New Executive Order: What’s the Catch?

Governor Cuomo rolled out an extension last week on the state’s moratorium on convictions through August.

In a surprising change from the earlier ban, the new order only applies to tenants unable to pay rent due to COVID-19 or who qualify for unemployment.

Speaking to The Real Deal, KMWB’s Nativ Winiarsky said that the latest order “does not preclude the initiation of a holdover proceeding,” but does contain caveats.

He expects business leaders in the coming days to ask the Governor to address the “cloud of uncertainty” surrounding the new order.

Nativ also told The Real Deal in a subsequent article that, “In crafting this language in such an obscure manner, they may have unintentionally done more harm than good.”
