KMWB Partner Joseph Goldsmith Presents Oral Argument at NYS Court of Appeals in Important Loft Law Case

On Thursday, January 6, 2022, KMWB Partner Joseph Goldsmith argued an important case before the NYS Court of Appeals, the highest Court in the State, on the intersection of the Loft Law and Rent Stabilization. In this case, Mr. Goldsmith asserted that the Appellate Division, First Department, erred in affirming the lower Court’s holding that the subject Interim Multiple Dwelling was subject to the Emergency Tenant Protection Act (“ETPA”) after the sale of rights and improvements pursuant to Multiple Dwelling Law §§286 (6) and 286(12) as to do so created an unresolvable conflict between the First and Second Departments, as well as between the Loft Law and the ETPA.
