KMWB Partners Secure Victory in Commercial Lease Dispute

KMWB recently successfully represented ISTA Holding Co Inc. in a commercial nonpayment proceeding against H Square Market Inc. (ISTA Holding Co Inc v. H Square Market Inc, LT-315810-24/NY). The Court ruled in favor of our client, awarding judgment in the amount of over $370,000.00.  The ruling, which can be found here, reaffirms property owners’ rights in lease enforcement and eviction matters.

The dispute arose upon H Square Market Inc.’s failure to meet its rental obligations, leading ISTA Holding Co Inc. to seek legal recourse. Tenant contested the proceeding, arguing against eviction. However, KMWB’s legal team effectively demonstrated that the lease terms were clear, the tenant had breached its obligations, and owner was entitled to money and possessory judgments as provided by law. The Court’s ruling confirms land owners’ rights to take legal action when tenants default, reinforcing the importance of lease compliance in commercial property management.
