Significant victory against a retail tenant in Loft Law building

KMWB and firm partner Joseph Goldsmith have secured a significant victory against a retail tenant after an 11-day trial with the completion of an eviction and money judgment for $2,684,641.26, which included all rent, additional rent, legal fees, and interest. The Court agreed with the firm’s client that the tenant’s failure to complete its build-out and open for business was the result of the tenant failing to adequately investigate and comprehend the requirements to build-out a restaurant in a building subject to NYC Loft Law and Department of Building requirements. As a result, the Court found any harm, issues, or delay was attributed to the tenant and not to any wrongdoing by the owner.
