Violation Dismissed by ECB

On December 7, 2016, KMWB secured dismissal of a violation issued by the Department of Buildings following a hearing conducted at the Environmental Control Board (Violation numbers 35188875H). The management company for the owner had been cited for “failure to comply with an order of the Commissioner” pertaining to the removal of a residential tenancy from a commercial space. The owner demonstrated that efforts were being made to remove the tenancy. The ECB dismissed the violation because the original Commissioner’s order directing the removal of the tenancy was issued against the building owner, while the “failure to comply” violation was issued to the owner’s management company, and was therefore the incorrect party. This dismissal saved the owner several thousands of dollars in fines.
