KMWB Successfully Defends Client in Partnership Dispute

Nativ Winiarsky and Abner Zelman recently successfully defended our client in a proceeding brought by the client’s partner to dissolve their two partnerships, which owned two valuable commercial properties in midtown Manhattan. The proceeding, alleging mismanagement and waste, sought to compel an accounting and have a receiver appointed to oversee the liquidation of the partnerships’ properties. As a result of the defense interposed by KMWB a settlement agreement was reached whereby the partner agreed to transfer to the client its interest in the partnerships, in exchange for client’s interest in three companies in which client and partner were members, on terms most advantageous to client.
