Court Denies Injunction: FARE Act Takes Effect Tomorrow

The Court has spoken. Further to our earlier correspondence today, REBNY’s motion seeking a preliminary injunction has been denied. As a result, the Fairness in Apartment Rental Expenses (FARE) Act will take effect as scheduled tomorrow, June 11, 2025.

As a result, starting tomorrow, brokers in New York City may no longer charge tenants a fee for rental listings if they list residential rental units on behalf of land owners or have published a rental listing with a land owner’s permission.

REBNY’s challenge will continue in Court, but strictly on the narrow issue of whether the FARE ACT improperly interferes with the Contracts Clause of the United States Constitution. As a result, the Act’s enforcement will move forward as intended.
