NYC Heating Season Requirements: What You Need to Know

As temperatures drop, New York City building operators are reminded of their legal obligations to maintain proper heat and hot-water levels throughout New York City’s heating season.
From October 1 through May 31, owners must:

  • Maintain indoor ambient temperature of at least 68°F between 6:00 a.m. and 10:00 p.m. when outdoor temperatures are below 55°F.
  • Maintain indoor ambient temperature of at least 62°F between 10:00 p.m. – 6:00 a.m., regardless of outdoor temperatures.
  • Ensure hot water remains at a minimum of 120°F at the source (i.e. faucets, taps, etc.).

Failure to comply with the foregoing requirements may result in HPD violations, penalties, and tenant complaints; particularly as HPD enforcement inspections increase during the City’s colder months.

Best Practices for Building Operators:

  • Verify boiler systems and sensors are functioning properly.
  • Remind staff to document all temperature readings and consistently update its maintenance logs.
  • Inspect radiators and valves for leaks or uneven heating.
  • Keep hallway and stairwell windows fully closed.
